Insolvency statutory advertising changes in April 2010

The Insolvency (Amendment) Rules 2010 came into force on Tuesday 6 April 2010, significantly affecting statutory advertising placed in insolvency cases in England and Wales.

The changes to insolvency legislation in 2010 are wide-ranging, so we have produced this webpage, a summary leaflet and a comprehensive guide covering the statutory advertising you need to place in the London Gazette and elsewhere.

The 2010 amendments to the insolvency advertising requirements are different in nature to those made in 2009, when mandatory newspaper advertising was replaced with discretionary additional publicity.

In April 2010 the principal change is the requirement for almost all insolvency notices – both in the Gazette and elsewhere – to include defined ‘standard contents’. These include information about the case and the IP handling it, and a consequence of this is the need to revise almost all notice text templates to ensure compliance.

Other changes relating to advertising include further information to be included in many notices, as well as more minor changes tidying-up and clarifying the advertising requirements and improving consistency within the rules.
