Terms and conditions

These Terms & Conditions (“Agreement”) govern your use of and access to websites (including www.tmpw.co.uk and any other website where this Agreement is posted), applications (including mobile applications), and content (the “Services”) made available by PeopleScout Limited or one of its subsidiaries or affiliates, and parent company, TrueBlue, Inc. (“PeopleScout”, “TMPW” “we”, “our”, or “us”). PeopleScout may, in its discretion, modify, supplement or amend this Agreement as it relates to your use of the Services from time to time, for any reason, and without any prior notice or liability to you or any other person.  You are advised to check this page regularly so that you are familiar with the most recent version.

1. ACCEPTANCE OF THIS AGREEMENT

Your use of or access to the Services constitutes your acceptance of this Agreement. If you do not want to agree to this Agreement in its entirety, do not access or use the Services.

2. AMENDMENTS TO THIS AGREEMENT

PeopleScout reserves the right, in its sole and absolute discretion, to change, modify, update, add or remove portions of this Agreement at any time. The new or modified terms will take effect immediately upon posting. When material changes are made to the Agreement, the changes will be effective after you provide your consent, or after you continue to use the Services. You should review this Agreement every time you visit our website or use the Services. If you do not agree to the amended terms, you must stop using the Services.  If you continue to use this website after any revisions are made to this Agreement, you will be deemed to accept those revisions and will accordingly by bound by them.

3. SCOPE OF THIS AGREEMENT

PeopleScout collects, uses and discloses information regarding your use of the Services and your personal information in accordance with our Privacy Policy which may be found at https://www.tmpw.co.uk/https://www.tmpw.co.uk/privacy-policy/privacy-policy/ , which is incorporated into this Agreement by this reference. This Agreement, the Privacy Policy, and all other agreements that you, or any persons you represent, have with PeopleScout or its service providers, suppliers, or contractors (“Providers”), now or in the future, together constitute the entire agreement regarding your access to and use of the Services, and supersede all previous agreements, whether written or oral, regarding your access to and use of the Services. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of any other agreement that you have with us or our Providers, now or in the future, the provisions of this Agreement shall govern regarding your access to and use of the Services.

This Agreement is in addition to and supplements any written agreements, if any, that you or any persons you represent have with PeopleScout or its Providers, now or in the future.

4. INTELLECTUAL PROPERTY

PeopleScout and our licensors retain full ownership, intellectual property rights and protection in all material contained in the Services including, but not limited to, all digital images, software, source code and other code, or business methods. Subject to the terms of this Agreement, you are granted a limited, non-sublicensable, revocable license to access and use the Services for lawful informational related purposes only. Access and use of any content, information and related materials that may be made available through the Services is made available solely for your personal use. Except as otherwise expressly provided in this Agreement, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, rewrite, modify, create derivative works from, download (other than the page caching), transfer or sell any material contained within the Services, or use the Services other than for their intended purpose without the prior consent of PeopleScout or the respective owner.

The Services may only be used in the manner described expressly in this Agreement. In particular, except as expressly stated otherwise in this Agreement, you may not copy, imitate, reproduce, republish, link to, upload, post, transmit, modify, index, catalogue, mirror or distribute in any way, in whole or in part the Services, nor cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, nor otherwise data mine any portion of the Services or unduly burden or hinder the operation and/or functionality of any aspect of the Services, without the express prior written consent of PeopleScout.

PeopleScout, the PeopleScout and TMP logo, and other marks and logos appearing within the Services are registered or unregistered trademarks, trade names, or service marks owned or licensed by PeopleScout. Other product and company names and logos appearing within the Services may be registered or unregistered trade names, trademarks or service marks of their respective owners. Any use of the trade names, trademarks, service marks, or logos (collectively “Marks”) displayed on the Services is strictly prohibited. Nothing appearing within the Services or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Marks displayed within the Services.

Any rights not expressly granted in these terms and conditions are reserved.

5. SERVICE ACCESS

While PeopleScout endeavours to ensure that this website is normally available 24 hours a day, PeopleScout shall not be liable if for any reason this website is unavailable at any time or for any period. Access to this website may be superseded temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond PeopleScout’s control.

Links to third party websites on this website are provided solely for your convenience. If you use these links, you leave this website. 9. OUTTHINK INDEX METHODOLOGY

The Services may include making our Outthink Index available on the website.  The methodology we utilized when developing the Outthink Index is as follows:

Social Reach

We assess on a 1 to 5 scale: the average number of interactions per post, average reach and average number of impressions.

Social Authority

We assess on a 1 to 5 scale: the month-over-month growth rate, total number of followers, follower count vs industry competitors, total brand mentions, brand share of voice and percentage of user generated content (UGC)

Social Impact

We assess on a 1 to 5 scale: the overall sentiment score/brand affinity, overall engagement rate, the ratio of work/career related vs generic content, the frequency of content posting and the presence of relevant “link in bio”.

Search

We assess on a 1 to 5 scale: if jobs for the organisation appear in the top 5 results from a simple job search on Google, if you can find careers related content about the organisation within 1 click of visiting the company website, and if the careers pages are mobile enabled.

Values and proposition

We assess on a 1-5 scale if the following information can be found within the careers pages: the mission, vision, purpose of the organisation; the company values; why you should join the organisation; corporate social responsibility initiatives, and the rewards and benefits offered.

Employee Experience

We assess on a 1-5 scale if the following information can be found within the careers pages: the culture of the organisation, flexible working (e.g. parental leave) and wellbeing (e.g. healthcare) and diversity and inclusion.

Content

We assess on a 1 to 5 scale careers content for the following: diverse representation of real employees across careers site pages; engaging videos of employees sharing their personal career development journey; engaging employee ‘day in the life’ videos that describe what it’s like to work for the organisation and what the day-to-day job is like, and engaging video tours of the working environment.

Candidate Experience

We assess on a 1 to 5 scale if the following information can be found on the careers pages: the opportunity for candidates to have peer to peer conversations and connect with employees via live chat; hints, tips and advice about the recruiting process; overview of key stages of the recruiting process and breakdown of assessment process; FAQs; opportunity to join a talent community, and opportunity to register interest or sign up for job alerts.

UX

We assess on a 1 to 5 scale the user experience including: mobile enabled application process; one click apply option on LinkedIn, and one click access to the job search when visiting the careers pages.

10. TERMINATION OF THIS AGREEMENT AND THE SERVICES

PeopleScout may, at any time and for any reason and in its sole discretion: (a) change, suspend or terminate, temporarily or permanently, the Services or any part of it; or (b) restrict, suspend or terminate, in whole or in part, your permission to access or use the Services; all without any notice or liability to you or any other person. If this Agreement or your permission to access or use the Services is terminated, then: (a) this Agreement and all other then existing agreements between PeopleScout and any persons you represent will continue to apply and be binding regarding your prior access to and use of the Services, and anything connected with, related to or arising therefrom; and (b) PeopleScout may continue to use and disclose your personal information in accordance with the Privacy Policy as amended from time to time. If you breach any provision of this Agreement, you may no longer use the Services. All sections which by their nature should survive the termination of this Agreement shall continue in full force and effect subsequent to and notwithstanding the termination of this Agreement. 

11. GOVERNING LAW AND JURISDICTION

These terms and conditions are governed by and construed in accordance with the laws of England and Wales and any disputes are to be decided only by the courts of England and Wales.

12. MISCELLANEOUS

If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, such determination will not affect the validity of any other provision and the provision in question shall be reformed to reflect the intent of the provision to the greatest extent possible.

Notwithstanding anything herein to the contrary, all provisions necessary for their interpretation or enforcement, will survive indefinitely after the termination of this Agreement and remain in full force and effect and be binding upon the parties as applicable. The provisions of this Agreement will inure to the benefit of and be binding upon each of PeopleScout and the Providers and each of their respective successors and assigns and related persons, and you and your heirs, executors, administrators, successors, and personal representatives, and all persons you represent and their respective successors, assigns and related persons. You and the persons you represent may not assign this Agreement or the rights and obligations under this Agreement without the express prior written consent of PeopleScout, which may be withheld in PeopleScout’s discretion. PeopleScout may assign this Agreement and its rights and obligations under this Agreement without your consent or the consent of any persons you represent.

No consent or waiver, by any party, to or of any breach or default by any other party in its performance of its obligations under this Agreement will be deemed or construed to be a consent to or waiver of a continuing breach or default or any other breach or default of those or any other obligations of that party. No consent or waiver will be effective unless in writing and signed by all parties. Any rights not expressly granted by this Agreement are reserved to PeopleScout.

PeopleScout reserves the right to inform law enforcement of any illegal activity or material we suspect or discover on, through, or otherwise related to the Services and to provide law enforcement officials with all requested information about the user account from which the illegal activity or material originated.
